Our privacy commitments

ViiBR is built for independent music creators, listeners, and communities. We believe using a music platform should not require giving up control of your personal information or creative work.

Your creative work remains yours

Music, lyrics, artwork, videos, recordings, images, and other original content you provide to ViiBR remain yours or the property of the applicable rights holder.

Using ViiBR does not transfer ownership of your creative work to ViiBR. Any limited rights ViiBR requires to host, display, stream, promote, or otherwise operate the Service are described in our Terms of Service.

We do not sell your personal information

ViiBR does not sell your personal information to data brokers, advertisers, marketers, or other third parties.

We do not use your creative work to train generative AI models

Unless you separately and expressly agree otherwise, ViiBR does not use music, lyrics, artwork, voice recordings, messages, prompts, or other creative material you submit to train or fine-tune generative artificial intelligence models.

We also do not sell or license your private creative material to third parties for the purpose of creating AI-training datasets.

You have choices

Where ViiBR provides optional communications, promotional notifications, advertising preferences, or similar features, we will provide appropriate choices concerning those uses.

2. Information we collect

The information ViiBR processes depends on which features you use.

2.1 Account and profile information

When you create or maintain a ViiBR account, we may collect information such as:

• email address;
• username;
• display name or artist name;
• password or authentication credentials processed through our authentication provider;
• profile photograph, avatar, or header image;
• biography;
• website and social-media links;
• general location information you voluntarily provide;
• creator or artist information; and
• account preferences and settings.

We do not require you to make all profile information public.

2.2 Music and creative content

When you submit, upload, link, publish, enter, or otherwise share creative material through ViiBR, we may process:

• music and audio recordings;
• links to music hosted on third-party services;
• track titles and metadata;
• artist or creator names;
• album or cover artwork;
• lyrics;
• videos and images;
• descriptions;
• credits;
• genre and category information;
• contest or playlist submissions; and
• other information associated with your creative work.

Some content may be designated by you for public display while other content or submissions may remain private or available only for particular ViiBR features.

2.3 Community and social activity

ViiBR may collect information generated through community features, including:

• comments;
• follows;
• likes or reactions;
• playlists;
• favorites;
• messages;
• contest participation;
• ratings or votes;
• reports;
• moderation interactions;
• support requests; and
• other activity performed through social or community features.

2.4 Listening and platform activity

To operate and improve ViiBR, we may record information regarding how the Service is used, including:

• tracks played;
• listening duration;
• playback completion;
• repeat listening;
• playlist activity;
• searches;
• follows;
• clicks;
• interactions with creator pages;
• contest participation;
• content engagement; and
• other actions performed through the Service.

We may use this information to operate features, personalize the Service, recommend or rank content, produce creator analytics, understand engagement, identify manipulation or abuse, and improve ViiBR.

2.5 Technical information

When you access ViiBR, we or our service providers may automatically receive technical information such as:

• IP address;
• browser type;
• device type;
• operating system;
• referring page or website;
• pages or features accessed;
• timestamps;
• approximate geographic information derived from an IP address;
• device or session identifiers;
• crash or diagnostic information; and
• security and request logs.

We may use this information to provide the Service, maintain security, prevent abuse, diagnose technical problems, understand performance, and improve ViiBR.

2.6 Transaction and payment information

If ViiBR offers purchases, subscriptions, tips, merchandise, paid creator features, payouts, or other transactions, ViiBR and its payment service providers may process information related to those transactions.

This may include transaction amount, payment status, payout status, billing information, and identifiers required to associate a transaction with your account.

Payment processors may collect payment-card, banking, identity-verification, tax, or similar financial information directly from you. ViiBR does not intend to store full payment-card numbers when those transactions are handled by an independent payment processor.

2.7 Communications with ViiBR

We may retain communications you send to us, including:

• customer-support requests;
• copyright or DMCA notices;
• reports of misconduct;
• privacy requests;
• business inquiries;
• contest communications; and
• other correspondence.

3. Public information

ViiBR is designed in part to help creators share music and connect with listeners.

Information you intentionally make public may be visible to anyone, including people who do not have a ViiBR account.

Public information may include:

• artist or display name;
• avatar or profile image;
• biography;
• music and creative content;
• public playlists;
• comments;
• creator pages;
• social-media links;
• website links;
• contest participation;
• public reactions or engagement; and
• other information you choose to publish.

Please consider carefully what information you choose to make public.

Content marked private or submitted for a limited-purpose feature will not ordinarily be displayed publicly simply because it has been provided to ViiBR. ViiBR may nevertheless access or process such material when necessary to provide the requested feature, maintain security, enforce our Terms, investigate abuse, comply with law, or provide support.

4. How we use information

ViiBR may use information we collect to:

• create and maintain accounts;
• authenticate users;
• provide music playback and discovery features;
• display creator profiles and content;
• operate playlists, contests, streams, calendars, and community features;
• personalize a user’s ViiBR experience;
• recommend, rank, curate, or surface music and creators;
• measure engagement and listening activity;
• provide creator statistics and analytics;
• process transactions;
• communicate with users;
• send requested or authorized notifications;
• send newsletters and promotional communications;
• respond to support requests;
• enforce our Terms of Service and community rules;
• detect spam, fraud, manipulation, fake engagement, security threats, or other abuse;
• investigate complaints;
• comply with legal obligations;
• protect ViiBR, our users, creators, and third parties;
• diagnose technical problems;
• understand how ViiBR is being used; and
• develop, maintain, and improve the Service.

We may also use information for other purposes disclosed to you when the information is collected or with your consent where consent is required.

5. Creator, streamer, and event notifications

ViiBR may allow creators, streamers, event organizers, or other approved participants to promote streams, events, releases, playlists, or other activities through ViiBR.

Users may be given the option to subscribe to or opt into these promotional notifications.

When you opt in, ViiBR may deliver notifications on behalf of the applicable creator, streamer, or organizer.

Opting into a ViiBR notification does not, by itself, mean that ViiBR provides your email address or other private contact information directly to the creator, streamer, or organizer.

If a feature would provide your personal contact information directly to another party, we will disclose that before you choose to participate.

You may withdraw from optional promotional notifications using the controls provided by ViiBR.

6. Email and marketing communications

ViiBR may send:

• account verification messages;
• password-reset messages;
• security notices;
• service announcements;
• account notifications;
• event information;
• platform news;
• creator or playlist promotions;
• newsletters;
• special announcements; and
• other marketing communications.

Where required by applicable law, we will obtain appropriate consent before sending marketing communications.

Marketing emails will provide a method for unsubscribing from future marketing messages.

Even if you unsubscribe from promotional communications, we may continue to send non-promotional messages necessary to administer your account, provide requested services, communicate important legal or security information, or complete transactions.

7. Advertising and sponsorships

ViiBR may support the Service through advertising, sponsorships, promoted events, promoted creators, banner advertising, audio advertising, playlist sponsorships, radio-style advertisements, promotional overlays, or similar commercial arrangements.

The presence of advertising on ViiBR does not mean that ViiBR sells advertisers your personal information.

ViiBR does not currently sell personal information.

ViiBR may use contextual information to determine where advertising or sponsored content appears. For example, an advertisement may be associated with a particular playlist, genre, program, event, or section of ViiBR without creating a behavioral advertising profile about an individual user.

If ViiBR later introduces advertising technology or data practices that are legally considered the “sale,” “sharing,” or use of personal information for targeted or cross-context behavioral advertising, ViiBR will update this Privacy Policy and provide notices, consent mechanisms, opt-out mechanisms, or other controls required by applicable law before or in connection with those practices.

Where applicable, ViiBR will honor legally recognized privacy preference signals as required by law.

8. Cookies and similar technologies

ViiBR and our service providers may use cookies, local storage, pixels, session identifiers, or similar technologies.

These technologies may be used for purposes such as:

Essential functions

To keep users signed in, authenticate accounts, provide playback, maintain security, remember sessions, and operate core features.

Preferences

To remember settings such as display preferences, playback settings, or other user choices.

Analytics

To understand how users interact with ViiBR, diagnose problems, measure performance, and improve the Service.

Advertising

If ViiBR introduces advertising technologies in the future, additional cookies or similar technologies may be used for advertising purposes.

Where required by law, ViiBR will obtain consent or provide appropriate choices before using non-essential cookies or similar technologies.

Browser settings may permit you to block or delete cookies, although doing so may prevent some parts of ViiBR from functioning correctly.

9. How we share information

ViiBR does not sell your personal information.

We may share information in the following circumstances.

Service providers

We may provide information to companies that perform services on our behalf, such as:

• website and application hosting;
• cloud storage;
• database services;
• authentication;
• cybersecurity;
• analytics;
• email delivery;
• customer support;
• content delivery;
• payment processing; and

These providers may process information only as necessary to provide their services to ViiBR, subject to applicable agreements and legal obligations.

Information you make public

Content or profile information you intentionally publish through ViiBR may be accessible to other users and the public.

With your direction or consent

We may share information when you direct us to do so, request a feature that requires sharing, connect ViiBR to another service, or otherwise consent to the disclosure.

Business transactions

If ViiBR is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction, information may be disclosed or transferred as part of that transaction, subject to applicable law.

Legal and safety reasons

We may disclose information when we reasonably believe doing so is necessary to:

• comply with applicable law;
• respond to valid legal process;
• enforce our agreements;
• investigate fraud or unlawful conduct;
• protect the security of ViiBR;
• protect the rights, property, or safety of ViiBR, our users, creators, or others; or
• respond to an emergency involving a risk of harm.

10. Third-party services and links

ViiBR may allow users to submit or interact with links or content from third-party platforms, including music, video, social-media, streaming, payment, merchandise, or other services.

Those third parties may process information independently under their own privacy policies.

ViiBR’s Privacy Policy does not control the privacy practices of independent third-party websites, applications, or services.

We encourage users to review the privacy practices of services they choose to visit or use.

11. Creative content and artificial intelligence

Creators retain ownership of the rights they hold in their original creative content.

ViiBR does not treat a user’s music, lyrics, artwork, voice, likeness, private communications, prompts, or other creative material as a ViiBR-owned asset merely because the material is submitted to the Service.

Unless you separately and expressly agree otherwise:

• ViiBR will not use your creative material to train or fine-tune generative AI models;
• ViiBR will not sell or license your creative material as an AI-training dataset; and
• submission of creative content to ViiBR does not constitute consent for AI training.

ViiBR may use automated systems, algorithms, or machine-learning tools for operational purposes such as search, recommendation, moderation, fraud detection, analytics, ranking, security, or other Service functionality. Such operational use does not transfer ownership of your creative material to ViiBR.

If ViiBR introduces an optional generative-AI feature that requires user content to be provided to an AI service provider, we will provide information about that processing as appropriate before or when the feature is used.

12. Aggregated and de-identified information

We may create statistics, reports, analytics, or other information that has been aggregated or de-identified so that it cannot reasonably be linked to a particular individual.

We may use such information to:

• understand platform performance;
• measure audience activity;
• improve ViiBR;
• analyze music and listening trends;
• provide statistics to creators;
• evaluate business performance; and
• communicate aggregate platform metrics.

We will not intentionally use the label “aggregated” or “de-identified” as a means of circumventing the commitments in this Privacy Policy concerning identifiable user information or private creative content.

13. Data retention

We retain personal information for as long as reasonably necessary for the purpose for which it was collected, including to:

• maintain an active account;
• provide the Service;
• maintain transaction records;
• meet legal, tax, or accounting obligations;
• resolve disputes;
• prevent fraud or abuse;
• maintain security;
• enforce our agreements; and
• protect legitimate business interests.

When information is no longer reasonably necessary, we may delete or de-identify it.

Information may remain temporarily in backups or disaster-recovery systems after deletion from active systems.

Certain records may be retained after an account is deleted when required or permitted by law or when reasonably necessary for fraud prevention, security, dispute resolution, enforcement, or other legitimate purposes.

14. Account deletion and content removal

Users may request deletion of their ViiBR account and personal information using available account controls or by contacting ViiBR.

Deleting your account may result in deletion or removal of associated content, subject to applicable legal requirements and legitimate retention needs.

Content that has already been independently shared, downloaded, reposted, embedded, captured, or otherwise distributed by other users or third parties may continue to exist outside ViiBR’s control after the original content is removed from ViiBR.

We may retain limited information where required or permitted by law.

15. Your privacy rights

Depending on where you live, you may have legal rights concerning your personal information.

These rights may include the right to:

• know whether we process personal information about you;
• request access to personal information;
• request correction of inaccurate information;
• request deletion of personal information;
• obtain a portable copy of certain information;
• object to or restrict certain processing;
• withdraw consent where processing is based on consent;
• opt out of certain forms of targeted advertising;
• opt out of the sale or sharing of personal information;
• appeal certain decisions concerning a privacy request; and
• receive equal service without unlawful discrimination for exercising privacy rights.

Not every right applies in every jurisdiction or circumstance.

We may need to verify your identity before completing certain requests.

Where permitted by applicable law, an authorized agent may submit a request on your behalf. We may require evidence that the agent is authorized to act for you.

ViiBR will respond to valid privacy requests within the period required by applicable law.

16. International users

ViiBR Music LLC is based in the United States.

If you access ViiBR from another country, your information may be transferred to, stored in, or processed in the United States or other countries where ViiBR or our service providers operate.

Privacy and data-protection laws may differ between countries.

Where applicable law requires safeguards for international transfers of personal information, ViiBR will use appropriate legal mechanisms or safeguards.

Users in the European Economic Area, United Kingdom, Switzerland, or other jurisdictions may have additional privacy rights under applicable local law.

17. Children and teen users

ViiBR is intended for users 13 years of age or older.

Children under 13 may not create or use a ViiBR account.

We do not knowingly collect personal information from children under 13.

If we learn that an individual under 13 has provided personal information to ViiBR in violation of this policy, we will take reasonable steps to delete the information and terminate or restrict the applicable account as appropriate.

Users between 13 and the age of legal majority in their jurisdiction may be required to have permission from a parent or legal guardian where required by applicable law or by ViiBR’s Terms of Service.

18. Security

ViiBR uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

However, no internet service, database, transmission method, or security system can be guaranteed to be completely secure.

Users are responsible for maintaining the confidentiality of their account credentials and should notify ViiBR promptly if they believe their account has been compromised.

19. Changes to this privacy policy

ViiBR may update this Privacy Policy as our Service, technology, business practices, or legal obligations change.

When we make material changes, we may notify users through the Service, by email, or through another appropriate method.

The “Last Updated” date at the beginning of this policy will identify the most recent revision.

Where applicable law requires consent to a new use of personal information, updating this Privacy Policy alone will not substitute for obtaining that consent.
